These Terms of Service ("Terms") govern your use of the Domiva mobile application, website, and related services (together, the "Service") operated by Domiva Ltd ("Domiva", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of terms
By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under the laws of the United Kingdom. By registering, you represent that you meet these requirements.
3. Your account
Registration
To use Domiva you must create an account and verify your email address. You are responsible for keeping your credentials secure and for all activity under your account.
Accurate information
You agree to provide accurate, current, and complete information and to keep it updated. We may suspend or terminate accounts that contain inaccurate or misleading information.
Account security
Notify us immediately at support@domiva.app if you suspect any unauthorised access to your account.
4. The service
Domiva provides a platform for tenants and landlords to manage rent payments, tenancies, documents, maintenance requests, and related housing activity. The Service is provided on an "as is" basis and we do not guarantee it will be uninterrupted, error-free, or available in every jurisdiction.
5. Payments and rent
Rent payments processed through Domiva are handled by third-party payment processors. By initiating a payment you authorise us and our processors to debit the relevant amount from your nominated payment method.
Domiva is not a bank, a lender, or a party to the tenancy agreement between landlord and tenant. We facilitate the movement of rent but do not guarantee the receipt, timing, or lawfulness of any individual payment.
You are responsible for any fees charged by your bank, card issuer, or payment processor. Any Domiva platform fees will be shown to you before you confirm a payment.
6. Landlord & tenant use
Tenancy agreements
The underlying tenancy between a landlord and tenant is a separate legal agreement between those parties. Domiva is not a party to that agreement. Any dispute about rent owed, condition of the property, or ending a tenancy must be resolved between landlord and tenant in accordance with the tenancy agreement and applicable law.
Access codes
Landlords generate access codes to link tenants to properties. You must not share your access code with anyone who is not the intended tenant.
Domiva Score
The Domiva Score is a non-regulated indicator based on on-platform activity. It is provided for informational purposes only and is not a credit score under the Consumer Credit Act or equivalent legislation.
7. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, including money laundering or fraud;
- misrepresent your identity or role (e.g. register as a landlord for a property you do not own or manage);
- attempt to gain unauthorised access to any account or to our systems;
- reverse engineer, scrape, or interfere with the Service;
- upload malicious code, harassment, hate speech, or content that infringes someone else's rights.
We may suspend or terminate accounts that breach this section.
8. Your data
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Where you upload documents or information relating to another person (for example, a tenant uploading a shared tenancy contract), you confirm you have the right to do so.
9. Limitation of liability
To the fullest extent permitted by law, Domiva is not liable for:
- indirect, incidental, or consequential loss;
- loss of profit, business, or anticipated savings;
- loss or corruption of data beyond what could reasonably have been foreseen;
- the acts or omissions of any landlord, tenant, or payment processor.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot lawfully be excluded.
10. Termination
You may delete your account at any time from your profile. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends immediately, though some obligations (e.g. payment records) survive.
11. Changes to these terms
We may update these Terms from time to time. If a change is material we will notify you via the app or by email. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.
12. Governing law
These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident elsewhere in the UK in which case the courts of your jurisdiction will also have non-exclusive jurisdiction.
